Residential User Terms of Use

 

These RESIDENTIAL USER TERMS OF USE govern the relationship between the USER (“USER”) and HighriseSocial.com LLC (“COMPANY”), an Illinois Limited Liability Company.

 

  1. USER agrees and acknowledges they are being granted a limited, revocable, non-exclusive, non-assignable, and non-sublicensable license to access and participate on Highrisesocial.com (“WEBSITE”) for their benefit and experience exclusively for their listed building (“Building”) while being a resident.

 

  1. USER agrees not to copy, reproduce, license, distribute, make derivative websites/applications, display, sell, or frame content from WEBSITE, excluding content you created. USER understands that it is illegal to use any method of obtaining, scaping or copying COMPANY’s information and/or sharing any information pertaining to COMPANY or WEBSITE without COMPANY’s prior consent.

 

  1. USER grants COMPANY a perpetual, irrevocable, unlimited, worldwide, fully paid/sub-licensable license to use, copy, perform, display, distribute, and make derivative works from content you post (See our Privacy Policy below).

 

  1. USER acknowledges that there is a 1-time cost of $1 to join WEBSITE and verify address which will permit their access to the Personal Section, Building Marketplace, and Lifestyle Directory. In the event the USER is unable to verify account, USER will not be granted access and will not be charged $1.

 

  1. In addition to these permitted areas, WEBSITE contains paid areas for access and the ability to post in the Professional Section and Sub-Sections, where the USER’s goal is monetary gain.

 

  1. Regarding all transaction, USER authorizes COMPANY to charge USER account for WEBSITE fees. Unless noted, fees are in US dollars; tax is additional (if charged).
(a) To the extent permitted by law, fees are non-refundable, even for posts COMPANY removes.

(b) USER is granted access to paid areas for the duration of their subscription or when USER moves from the building, whichever is shorter.

(c) COMPANY may refuse purchases, which may place a hold on USER account.

 

  1. By registering with the WEBSITE, USER warrants:

 

(a) That he/she will abide by the WEBSITE’s Terms of Use (“TOU”).

(b) That they are 18 years of age or older.

(c) If under 18, that they have the legal consent of their parent or legal guardian.

(d) That they are a current resident of the building they are registering in.

(e) That the information provided by them is honest and accurate.

(f) Any representation of themselves, their goods, services, and offerings are accurate.

(g) They will adhere to WEBSITE’s Code of Conduct (see below or link).

 

 8. WEBSITE contains a Lifestyle Directory Area containing paid listings with the intention of making these services and products easily accessible to facilitate an on-demand lifestyle.

 

(a) It is expressly understood by USER that WEBSITE AND COMPANY does not, nor is under any obligation to, conduct any background checks on any individuals or companies participating in WEBSITE.
 
(b) Unless stated otherwise, COMPANY does not endorse any good, service, or individual offering these goods/services being shown. 
 
(c) In the event COMPANY and WEBSITE does endorse a product or is an affiliate, this information will be displayed in a clear and concise manner. 

   

  1. Warranties and Limited Liability:

 To the extent permitted by law the USER agrees:

(a) That COMPANY makes no promise as to WEBSITE, its’ completeness, accuracy, availability, timeliness, propriety, security or reliability.

(b) USER access and use are at your own risk, and WEBSITE is provided "AS IS" and "AS AVAILABLE".
 
(c) USER understands that website performance is of the utmost importance to COMPANY and WEBSITE, but upon any issues with WEBSITE performance, USER agrees to hold COMPANY, its' websites, its' employees, affiliates, advertisers, or anyone involved in doing business with any result of participating on the WEBSITE harmless.
 
(d) Further, COMPANY is not liable for any harm resulting from (i) user content; (ii) user conduct, i.e. illegal conduct; (iii) your WEBSITE use; or (iv) our representations; (v) your building’s representations; (vi) our advertiser’s representations including any typographical error or omission by COMPANY, WEBSITE, or any advertisers.

(e) USER assumes complete responsibility for any good, service, and transaction on WEBSITE before, during, or after the transaction.

(f) COMPANY, OUR OFFICERS, DIRECTORS, EMPLOYEES ("COMPANY ENTITIES"), YOUR BUILDING AND ITS’ EMPLOYEES & REPRESENTATIVES, BUILDING ADVERTISERS, DISCLAIM
ALL WARRANTIES & CONDITIONS, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, OR NON-INFRINGEMENT;

(g) COMPANY ENTITIES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS (i.e. OF PROFIT, REVENUE, DATA, OR GOODWILL).

(f) In no event shall our total liability exceed $100.00 or what you paid us in the past year.


10. Claim

(a) USER agree that any claim, cause of action or dispute ("claim") arising out of or related to the TOU or your WEBSITE use is governed by Illinois ("IL") law regardless of your location or any conflict or choice of law principle.

(b) That claims must be resolved exclusively by state or federal court in Chicago, IL (except we may seek injunctive remedy anywhere).

(c) To submit to personal jurisdiction of said courts.

(d) That any claim must be filed by 1 year after it arose or be forever barred.

(e) Not to bring or take part in a class action against COMPANY and WEBSITE Entities.

(f) (Except government agencies) to indemnify COMPANY Entities for any damage, loss, and expense (i.e. legal fees) arising from claims related to your WEBSITE use.

(g) USER is liable for TOU breaches by affiliates (i.e. marketers) paid by USER, directly or indirectly (i.e. through an affiliate network).

(h) To pay COMPANY for breaching or inducing others to breach the "USE" section, not as a penalty, but as a reasonable estimate of our damages (actual damages are often hard to calculate): $0.10 per server request, $1 per post, email, flag, or account created, and $1000 per software distribution, capped at $25,000 per day.


11. Prior Licenses and Other Conflicts

(a) USERs complying with prior written licenses may access WEBSITE thereby until authorization is terminated. Otherwise, this is the exclusive and entire agreement between us. If a TOU term is unenforceable, other terms are unaffected. If TOU translations conflict with the English version, English controls.


12. Taxes

(a) In the event of any monetary profit made by USER that was obtained by using WEBSITE, USER assumes full and complete responsibility for any applicable taxes resulting from any transactions and the payment of any such applicable taxes is not the responsibility of COMPANY or WEBSITE.

 

 13. USER access for the listed building is revoked upon the USER violating Terms of Use, Completion/Termination of Lease, or Sale of Residence.

 14. In the event the user moves to another WEBSITE building, USER may contact WEBSITE to reassign to new building or create a new user.

 15. These Terms of Use shall be governed by and will be construed in accordance with the laws of the State of Illinois.

 

 

 

CODE OF CONDUCT

The Golden Rule - “Treat others as you wish to be treated.”


The aim of HighriseSocial.com is to create a positive and safe community and facilitate an enjoyable personal and professional life by following the Golden Rule. 

1. Therefore USER agrees to promote a positive and safe environment and not cause physical or emotional harm onto other USERs on WEBSITE.

2. USER will not use distasteful language, discuss illegal or harmful activities to others, bully others, force others against their will, or share any personal information that could be considered damaging.

3. USER will represent yourself and / or products honestly, fairly, and accurately

4. USER will obey the law, follow site rules, and not post prohibited items.

 

PROHIBITED ITEMS

Users must comply with all applicable laws, and all posted site rules.

Here is a partial list of goods, services, and content prohibited on HighriseSocial.com:

  • Weapons; firearms/guns and components; BB/pellet, stun, and spear guns; etc.
  • Ammunition, clips, cartridges, reloading materials, gunpowder, fireworks, explosives
  • Recalled items; hazardous materials; body parts/fluids; unsanitized bedding/clothing
  • Prescription drugs, medical devices; controlled substances and related items
  • Alcohol or tobacco; unpackaged or adulterated food or cosmetics
  • Child pornography; bestiality; offers or solicitation of illegal prostitution
  • Pet sales (re-homing with small adoption fee ok), animal parts, stud service
  • Endangered, imperiled and/or protected species and any parts thereof, i.e. ivory
  • False, misleading, deceptive, or fraudulent content; bait and switch; keyword spam
  • Offensive, obscene, defamatory, threatening, or malicious postings or email
  • Anyone’s personal, identifying, confidential or proprietary information
  • Food stamps, WIC vouchers, SNAP or WIC goods, governmental assistance
  • Stolen property, property with serial number removed/altered, burglary tools, etc.
  • ID cards, licenses, police insignia, government documents, birth certificates, etc.
  • US military items not demilitarized in accord with Defense Department policy
  • Counterfeit, replica, or pirated items; tickets or gift cards that restrict transfer
  • Lottery or raffle tickets, sweepstakes entries, slot machines, gambling items
  • Spam; miscategorized, or overposted content
  • Postings or emails for which the primary purpose is to drive traffic to a website
  • Postings or emails offering, promoting, or linking to unsolicited products or services
  • Affiliate marketing; network, or multi-level marketing; pyramid schemes
  • Any good, service, or content that violates the law or legal rights of others.

  • We may communicate with your building’s owners and representatives to verify your residence, including lease expiration and that your account is up-to-date.
  • We will use your non-specific identifying information with our advertisers (i.e. age range, gender, interests, professional title, etc.) at our discretion to help them better market relevant information specific to you.  We will not disclose your name or specific address (unit #).
  • In the event we correspond via email, we may use your personal information when contacting to inform you of a notification, providing information that may be of interest to you, or sharing marketing and promotional materials.  You may choose to opt-out of receiving any or all of these communications through the unsubscribe link at the bottom of the email.
  • We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification.  However, no method of transmission over the internet or method of electronic storage is 100% secure so we cannot guarantee its' absolute security.

  • Credit card data, which is transmitted to payment processors via a security protocol (i.e. SSL).
  • Data you submit or provide (i.e. name, username, address, email, phone, photos, tax ID).
  • Web log data (i.e. web pages viewed, access times, IP address, HTTP headers).
  • Data about your device(s) (i.e. screen size)
  • Data from 3rd parties (i.e. phone type, geo-location via IP address).

Data we store:
  • We retain data as needed for our business purposes and/or as required by law.
  • We make good faith efforts to store data securely, but can make no guarantees.
